Terms of Service
1. Who we are and acceptance
Tharvik is operated by Jorge Chacon Garcia, an individual in Spain (details on the Legal notice). By creating an account you accept these Terms and the Privacy Policy. If you do not accept them, do not use Tharvik.
2. Who can use Tharvik
You must be at least 16 years old. You confirm your age when you sign up. If we learn an account belongs to someone under 16, we will close it and delete its data.
3. What Tharvik is - and is not
Tharvik is an AI-powered fitness and nutrition coaching service. Every reply is written by artificial intelligence, not by a human trainer, doctor, dietitian or physiotherapist. It is a general fitness and wellness tool.
Tharvik does not provide medical advice, diagnosis or treatment. Nothing it says - including training programmes, calorie targets, estimates from photos, comments on your technique or on an injury - replaces an assessment by a qualified health professional. See a doctor before starting a new programme, especially if you have an injury, a medical condition or are pregnant, and stop and seek care if something hurts or feels wrong. Tharvik's estimates and advice can be wrong; you remain responsible for what you decide to do.
4. Your account
Keep your username and passcode confidential. You are responsible for activity on your account. Do not use another person's identity or false information.
5. Acceptable use
Do not use Tharvik to break the law, to harm or harass anyone, to upload content you have no right to share, to extract or copy the underlying AI system or its prompts, to overload or attack the service, or to obtain access to other people's accounts or data.
6. Your content
You keep ownership of what you send. You allow us to process it only to run Tharvik for you, including sending it to the providers listed in the Privacy Policy (in particular the AI provider, DeepSeek, in China, which you consent to separately at sign-up).
7. Plans, price and payment
- Tharvik Coach is a paid subscription with three billing periods: monthly, every 6 months and yearly. The price for each period, and any taxes such as VAT that apply, are shown to you before you pay, on the checkout page.
- Payment is handled by Stripe. We never see your card details.
- The subscription renews automatically at the end of each period at the price then shown, until you cancel.
- Each plan includes a monthly coaching allowance. If you reach it, chat pauses until the next month; your usage is shown in Settings.
- We will tell you in advance, by a message in the app, if the price of your plan changes; the change applies from your next renewal and you may cancel before it.
8. Cancelling
You can cancel at any time in Settings → Manage subscription (Stripe's billing portal), as easily as you subscribed. Cancellation takes effect at the end of the period you have already paid for; you keep access until then. Deleting your account also cancels your subscription immediately.
9. Right of withdrawal and refunds
If you are a consumer in the EU/EEA you have the right to withdraw from the contract within 14 days of subscribing without giving a reason. At checkout you ask for the service to start immediately; if you withdraw within the 14 days you will pay a proportionate amount for the service already provided up to the moment you tell us, and we will refund the rest. To withdraw, email tharvik.ai.help@gmail.com saying you withdraw and the username of your account; we will confirm by email and refund within 14 days. Apart from this and any other right the law gives you, payments are not refundable.
10. Availability and changes to the service
We work to keep Tharvik available but do not promise it will be uninterrupted or error-free. We may improve, change or discontinue features. If we discontinue the service we will refund the unused part of any prepaid period.
11. Suspension and termination
We may suspend or close an account that breaks these Terms or puts the service or others at risk, telling you why when the law requires. You may stop using Tharvik and delete your account at any time.
12. Results and liability
We do not promise any particular result (weight loss, strength, health outcomes). Nothing in these Terms limits liability that cannot be limited by law - including for intent or gross negligence, for death or personal injury caused by our fault, or your mandatory consumer rights. Beyond that, and to the extent the law allows, we are not liable for indirect losses, or for injury or harm resulting from your following AI-generated advice without seeking professional guidance where appropriate.
13. Changes to these Terms
We may update these Terms. We will tell you about material changes in the app in advance; if you do not agree you can cancel before they apply.
14. Governing law and complaints
These Terms are governed by Spanish law. If you are a consumer, you also keep the mandatory consumer protections of the country where you live and may bring a claim before the courts of your place of residence. For any complaint write to tharvik.ai.help@gmail.com; we reply within 30 days. You can also contact your local consumer authority.
Términos de Servicio
1. Quiénes somos y aceptación
Tharvik lo opera Jorge Chacon Garcia, persona física en España (datos en el Aviso legal). Al crear una cuenta aceptas estos Términos y la Política de Privacidad. Si no los aceptas, no uses Tharvik.
2. Quién puede usar Tharvik
Debes tener al menos 16 años. Confirmas tu edad al registrarte. Si detectamos que una cuenta pertenece a un menor de 16, la cerraremos y eliminaremos sus datos.
3. Qué es Tharvik - y qué no es
Tharvik es un servicio de coaching de fitness y nutrición basado en inteligencia artificial. Cada respuesta la escribe una IA, no un entrenador, médico, dietético o fisioterapeuta. Es una herramienta general de fitness y bienestar.
Tharvik no ofrece consejo médico, diagnóstico ni tratamiento. Nada de lo que dice - programas de entrenamiento, objetivos de calorías, estimaciones a partir de fotos, comentarios sobre tu técnica o sobre una lesión - sustituye la valoración de un profesional sanitario cualificado. Consulta a un médico antes de empezar un programa nuevo, sobre todo si tienes una lesión, una afección médica o estás embarazada, y para y busca atención si algo duele o no va bien. Las estimaciones y consejos de Tharvik pueden ser erróneos; tú sigues siendo responsable de lo que decidas hacer.
4. Tu cuenta
Mantén tu usuario y código confidenciales. Eres responsable de la actividad de tu cuenta. No uses la identidad de otra persona ni información falsa.
5. Uso aceptable
No uses Tharvik para infringir la ley, dañar o acosar a nadie, subir contenido que no tienes derecho a compartir, extraer o copiar el sistema de IA subyacente o sus instrucciones, sobrecargar o atacar el servicio, u obtener acceso a cuentas o datos de otras personas.
6. Tu contenido
Conservas la propiedad de lo que envías. Nos autorizas a tratarlo solo para prestarte Tharvik, incluido enviarlo a los proveedores de la Política de Privacidad (en particular el proveedor de IA, DeepSeek, en China, al que consientes por separado al registrarte).
7. Planes, precio y pago
- Tharvik Coach es una suscripción de pago con tres periodos: mensual, cada 6 meses y anual. El precio de cada periodo, y los impuestos (como el IVA) que apliquen, se te muestran antes de pagar, en la página de pago.
- El pago lo gestiona Stripe. Nunca vemos los datos de tu tarjeta.
- La suscripción se renueva automáticamente al final de cada periodo al precio vigente entonces, hasta que canceles.
- Cada plan incluye una cuota mensual de coaching. Si la alcanzas, el chat se pausa hasta el mes siguiente; tu uso aparece en Ajustes.
- Te avisaremos con antelación, con un mensaje en la app, si cambia el precio de tu plan; el cambio se aplica desde tu siguiente renovación y puedes cancelar antes.
8. Cancelar
Puedes cancelar cuando quieras en Ajustes → Gestionar suscripción (portal de facturación de Stripe), tan fácilmente como te suscribiste. La cancelación surte efecto al final del periodo ya pagado; mantienes el acceso hasta entonces. Eliminar tu cuenta también cancela tu suscripción de inmediato.
9. Derecho de desistimiento y reembolsos
Si eres consumidor en la UE/EEE tienes derecho a desistir del contrato en 14 días desde que te suscribes, sin dar motivos. En el pago solicitas que el servicio empiece de inmediato; si desistes dentro de esos 14 días pagarás un importe proporcional al servicio ya prestado hasta que nos lo comuniques, y te reembolsaremos el resto. Para desistir, escribe a tharvik.ai.help@gmail.com indicando que desistes y el usuario de tu cuenta; te lo confirmaremos por email y reembolsaremos en 14 días. Salvo esto y cualquier otro derecho que te reconozca la ley, los pagos no son reembolsables.
10. Disponibilidad y cambios del servicio
Nos esforzamos por mantener Tharvik disponible, pero no prometemos que sea ininterrumpido ni libre de errores. Podemos mejorar, cambiar o retirar funciones. Si retiramos el servicio, reembolsaremos la parte no usada de cualquier periodo prepagado.
11. Suspensión y terminación
Podemos suspender o cerrar una cuenta que incumpla estos Términos o ponga en riesgo el servicio o a terceros, explicándote el motivo cuando la ley lo exija. Puedes dejar de usar Tharvik y eliminar tu cuenta en cualquier momento.
12. Resultados y responsabilidad
No prometemos ningún resultado concreto (pérdida de peso, fuerza, resultados de salud). Nada en estos Términos limita la responsabilidad que la ley no permite limitar - incluida la derivada de dolo o negligencia grave, la muerte o lesiones personales causadas por nuestra culpa, ni tus derechos de consumidor imperativos. Fuera de eso, y en la medida que la ley lo permita, no respondemos de pérdidas indirectas ni de lesiones o daños por seguir consejos generados por IA sin buscar orientación profesional cuando corresponda.
13. Cambios en estos Términos
Podemos actualizar estos Términos. Te avisaremos con antelación en la app de los cambios relevantes; si no estás de acuerdo, puedes cancelar antes de que se apliquen.
14. Ley aplicable y reclamaciones
Estos Términos se rigen por la ley española. Si eres consumidor, conservas además las protecciones imperativas del país donde resides y puedes acudir a los tribunales de tu domicilio. Para cualquier reclamación escribe a tharvik.ai.help@gmail.com; respondemos en 30 días. También puedes acudir a tu autoridad de consumo.
